My name is Mathew Swain & I Aggressively protecting my client's rights and freedom in criminal and DUI cases is what I do for a living, every day in courts across Oklahoma. For many people, being arrested and put in jail is the most humiliating and powerless feeling they've every experienced. But it's happened, and it's done. The good news is you've got some control back now. You can decide how you want to proceed.
Are you ready to fight back? That's what I'm here to do for you. Even if all you want to do is plead guilty and move on with your life, it often makes sense to take an aggressive posture to begin with. That way we leave all the options on the table, and have the most negotiating power.
Many people are hesitant to plead not guilty to a DUI charge. However, the consequences of a DUI conviction in Oklahoma is so damaging and expensive that most people who are arrested for drunk driving don't have a choice but to plead not guilty and fight the charge.
Matt Swain defends people charged with a wide variety of drunk driving offenses, including DUI (which refers to individuals under the age of 21 driving with any detectable amount of alcohol), APC (which refers to "Actual Physical Control" of a motorized vehicle while intoxicated), DWI ("Driving While Intoxicated") and charges from drunk driving accidents such as vehicular assault and vehicular homicide. We will also represent you at your hearing with the Oklahoma Department of Public Safety to try and prevent your driver's license suspension if you failed or refused to take a Breathalyzer test.
VERY IMPORTANT
You only have 15 days to make a written request for a hearing, or you will lose your right to a hearing, and your driver's license for at least 6 months and possibly up to many years (depending on how many prior DUI's you have).
Call Attorney Matt Swain ASAP so that he can get started on the appeal for your Driver's License suspension! 405.501.0827
The defense in a DWI/DUI/APC case will often depend on whether you took a Breathalyzer test or not:
- If you took a Breathalyzer test, Matt Swain can challenge the breath test results. The Intoxilyzer or Breathalyzer machine used in Oklahoma is outdated and prone to error. The science behind this machine can be questioned through the use of expert witnesses in court.
- If you didn't take a Breathalyzer test, your case may come down to how you appeared on the video. Most arrests are videotaped in Oklahoma, and if you do not appear to be intoxicated on the video, that is fantastic for your case.
Attorney Matt Swain will also look for the reasons for the police stop. If the police did not have a legal reason to pull you over, all evidence collected after the stop, including the Breathalyzer test results and the video, can be dismissed.
While many criminal charges can be favorably resolved through negotiation and plea bargaining other cases, other cases may need to go to trial. We fight hard to obtain the best possible outcome for our clients, whether that is a dismissal of the charges, a guilty plea to a reduced charge, alternative sentencing or an acquittal.
