Daniel Melendez, 24, was arrested June 24 after the traffic accident at NW 10 and Pennsylvania Avenue.

No one was injured in the wreck. Melendez could not be reached for comment.

According to police, an officer stopped Melendez in his sport utility vehicle shortly after the accident, which happened just before midnight.

Police said Melendez slurred his speech so badly that most of what he said was unintelligible.

The officer said he found an open can of beer in the SUV’s cup holder. The SUV had fresh damage connecting it to the accident.

Melendez was arrested on complaints of aggravated drunken driving, leaving the scene of an accident, transporting an open container and driving under suspension.

His blood alcohol level was measured at 0.24 on one breathalyzer test and 0.23 on a second test, the report said.

According to Oklahoma County court records, Melendez pleaded guilty in January to a misdemeanor drunken driving charge filed in July 2010.

Melendez also pleaded guilty in February 2010 to transporting an open container.

Michael Allen Gardner, 47, pleaded guilty in Oklahoma City federal court to possession of a sawed-off rifle.

He was identified in a grand jury indictment as the national president of the Rogues Motorcycle Club. The gun was in his kitchen in January.

Under a plea deal, he agreed to serve 10 years in federal prison. Prosecutors agreed to dismiss eight drug-related offenses against him. A judge will rule later whether the agreement is acceptable.

Gardner also agreed to give up $1,900 and his legal interest in property in Oklahoma City known as the Rogues Clubhouse, prosecutor Ed Kumiega said.

The grand jury said Gardner has owned the clubhouse, 1920 S Central Ave., since 1994. The grand jury said the clubhouse has “a private room exclusively for Rogues members and invited guests for the use of” methamphetamine and other drugs.

Police in May searched his home at 3306 S Quapah Ave. for buried human remains. None were found.

Roger Frank Kincaid, 49, was convicted last month of first-degree murder for fatally stabbing Terry Lee Jobe four years ago. He was convicted of assault and battery with a deadly weapon for wounding another man, Kenneth Ruff.

He was staying with the two men at their Oklahoma City apartment.

A prosecutor said Jobe, 43, was stabbed 24 times.

At his formal sentencing Friday, Kincaid said the truth was not brought out at his jury trial.

“I believe there was a great mistake,” he said. “I wasn’t the perpetrator here. … I wasn’t in the apartment when it happened.”

A psychologist consulted by the defense concluded Kincaid could have been sleepwalking at the time of the homicide. The psychologist reported Kincaid would have been unaware and not in control of his actions.

Oklahoma County District Judge Glenn Jones refused to allow the jury to hear that opinion after a state expert pointed out severe problems with it.
