Driving under the influence (DUI) is determined by blood alcohol content (BAC).  The standard used to define DUI for adults over 21 in Oklahoma is BAC at .08 and above.  For minors driving under the influence the standard is set higher using a BAC level of .02.

Driving while intoxicated (DWI) is another term used for drunk driving charges.  When an individual refuses to submit to the chemical test to determine BAC, authorities may still bring DWI charges based on other factors.  Evidence being used by the prosecution may include:
•Sobriety tests
•Witness statements
•Camera surveillance
 •Officer observation and opinion
•Recorded statements

A Norman DUI defense lawyer begins preparing your defense by examining police visual and audio recordings.

Man arrested after blowing three times the legal limit following hit-and-run

Wednesday, July 6th, 2011

A man arrested on a complaint of aggravated drunken driving after a hit-and-run blew three times the legal limit on a breathalyzer test, police said.

Daniel Melendez, 24, was arrested June 24 after the traffic accident at NW 10 and Pennsylvania Avenue.

No one was injured in the wreck. Melendez could not be reached for comment.

According to police, an officer stopped Melendez in his sport utility vehicle shortly after the accident, which happened just before midnight.

Police said Melendez slurred his speech so badly that most of what he said was unintelligible.

The officer said he found an open can of beer in the SUV’s cup holder. The SUV had fresh damage connecting it to the accident.

Melendez was arrested on complaints of aggravated drunken driving, leaving the scene of an accident, transporting an open container and driving under suspension.

His blood alcohol level was measured at 0.24 on one breathalyzer test and 0.23 on a second test, the report said.

According to Oklahoma County court records, Melendez pleaded guilty in January to a misdemeanor drunken driving charge filed in July 2010.

Melendez also pleaded guilty in February 2010 to transporting an open container.

21 DWI charges over Mardi Gras in Austin

Monday, March 14th, 2011

Police said they arrested and charged 21 people with drunken driving during Austin’s Mardi Gras festivities Tuesday night and early Wednesday and collected the blood of 13 of those suspects.

Authorities said that of the 21 suspects, eight consented to a breath test while investigators sought search warrants to obtain the blood of eight motorists; two motorists were required by law to give a blood sample because they had been in a serious wreck, while three others consented to give a blood sample.
