DUI/DWI/APC
Many people are hesitant to plead not guilty to a DUI charge. However, the consequences of a DUI conviction in Oklahoma is so damaging and expensive that most people who are arrested for drunk driving don't have a choice but to plead not guilty and fight the charge.

The defense in a DWI/DUI/APC case will often depend on whether you took a Breathalyzer test or not:
- If you took a Breathalyzer test, Matt Swain can challenge the breath test results. The Intoxilyzer or Breathalyzer machine used in Oklahoma is outdated and prone to error. The science behind this machine can be questioned through the use of expert witnesses in court.
- If you didn't take a Breathalyzer test, your case may come down to how you appeared on the video. Most arrests are videotaped in Oklahoma, and if you do not appear to be intoxicated on the video, that is fantastic for your case.
Attorney Matt Swain will also look for the reasons for the police stop. If the police did not have a legal reason to pull you over, all evidence collected after the stop, including the Breathalyzer test results and the video, can be dismissed.
While many criminal charges can be favorably resolved through negotiation and plea bargaining other cases, other cases may need to go to trial.
